Attorney seeks reduction of child porn charges
DIXON – A hearing will be held June 18 on a motion to dismiss the complaint, or reduce the number of child pornography charges a rural Dixon man faces.
Ronald N. Osborn, 62, is charged with 20 counts of aggravated child pornography. Police say a search of his computer June 13 turned up multiple images of child pornography.
In the motion, filed Monday, defense attorney James Fagerman argued that the Illinois Appellate Court has found that simultaneous possession of multiple items of child pornography are part and parcel of the same crime, and cannot support multiple convictions.
The motion requests that the court dismiss the complaint as it is written or strike the counts that allege the commission of separate offenses for the same act.
A preliminary hearing for Susan E. Emmole was rescheduled for May 15.
Emmole, 44, of Dixon, is charged with residential burglary. Police say Emmole stole cash, coins, and watches from a home in northeast Dixon on Aug. 9.
A preliminary hearing for Dustin L. Jones, of Dixon, was moved to June 26 on a motion by the defense.
Jones, 31, was set to plea Wednesday. He is charged with possession with intent to deliver between 500 and 2,000 grams of marijuana, possession of between 500 and 2,000 grams of marijuana, and two misdemeanor counts of possession of drug paraphernalia.
Police say they found nearly 3 pounds of marijuana, smoking pipes, and guns in his home on Oct. 21, 2011.
