DIXON – An Amboy man is scheduled to enter a plea Friday in the 2014 death of his girlfriend’s 7-year-old daughter, who was thrown when the ATV he was driving hit a deer.
Brian Dees, 38, who admitted to using heroin 36 to 48 hours before the crash, is charged with two counts of aggravated DUI involving a death, two counts of DUI drugs, four counts of aggravated DUI resulting in bodily harm, and misdemeanor endangering the life of a child.
Dees was out on bond in that case when, about 6 months later, he was charged with theft of an item valued between $500 and $10,000. He’s been in Lee County Jail on $500,000 bond since.
Makenzie Rutherford suffered head and other injuries when the ATV hit the deer and rolled, also throwing her mom, Cassandra Gray, 29, and Dees. The crash happened around 7:30 p.m. on Aug. 3, 2014; she died 2 days later.
Dees and Gray also are codefendants in a wrongful death suit filed by Makenzie’s father, Steven R. Rutherford, on July 20, 2016. That case is on hold while Dees’ criminal case proceeds.
