Mistrial in case after witness killed

URBANA (AP) – A mistrial has been declared in an Urbana prosecution during which a witness was shot to death.

According to The News-Gazette, Champaign County Circuit Judge Tom Difanis declared a mistrial Thursday in the trial of 23-year-old Ardis Fenn after several jurors said they had heard news of the Monday shooting.

Fenn is charged with aggravated battery with a firearm in another shooting last June.

Curtis Mosely was injured in a robbery attempt.

Police say Mosley was shot to death Monday in Urbana. The next day Fenn did not appear for the scheduled start of his trial, but later surrendered to police. State’s Attorney Julia Reitz said Fenn was in court Thursday.

Difanis said he hopes to start the trial again next week with new jurors.
