Judge dismisses Sheley assault case
Prosecution files motion to avoid second trial
GALESBURG – Convicted murderer Nicholas T. Sheley won't face a second trial stemming from an attack on Knox County Jail guards in 2009.
In January, the Third District Appellate Court threw out his conviction, saying the trial court erred when it ruled Sheley suffered from a "serious mental illness" that prevented him from representing himself at trial.
Sheley already is serving life without parole in the June 2008 beating death of Ronald Randall, 65, of Galesburg.
